J’ai présenté mon rapport sur la directive DAC 5 où je propose d’échanger entre Etats les informations sur les bénéficiaires des sociétés et trusts. Voici le texte de mes interventions.

Mes chers collègues,

Je suis très heureux de vous présenter aujourd’hui ce texte et mon rapport modeste sur la proposition de la Commission.

Les scandales fiscaux à répétition, Swissleaks, Offshoreleaks, Luxleaks, Panama Papers et Bahamas Leaks, ont placé sous le feu des projecteurs la notion de « bénéficiaire effectif ». L’opacité fiscale réside souvent dans la possibilité de créer des montages qui, par un millefeuille de sociétés-écrans, de sociétés boîte-aux-lettres ou de prête-noms, cachent l’identité de celui qui reçoit ou possède l’argent qui échappe au fisc.

Les autorités publiques ont le plus grand intérêt et même le devoir de remédier à cette opacité, d’autant qu’elle sert aussi le blanchiment d’argent et le financement du terrorisme. La directive dite AMLD 4, en cours de révision, crée les instruments nécessaires pour débusquer les personnes derrières ces montages. Elle permet, au niveau national, l’identification de ces « bénéficiaires effectifs » des sociétés, à travers notamment l’établissement d’un registre central sécurisé. Ces données ne sont alors accessibles, en premier lieu, qu’aux « cellules de renseignement financier » de chaque État.

Cependant les administrations fiscales auraient, dans les conditions actuelles, un accès seulement indirect, et dans la pratique, pas toujours effectif, à ces données cruciales pour identifier les fraudeurs. C’est la raison pour laquelle la Commission propose, en parallèle, le texte dont il est question aujourd’hui. Celui-ci, dit « DAC 5 », donne un accès explicite, direct, et horizontal aux données sur les bénéficiaires effectifs pour les administrations fiscales.

Ce texte est donc le bienvenu, il confirme que quand elle le souhaite la Commission européenne sait se montrer diligente en matière de transparence.

Toutefois, le projet DAC 5 était légèrement incomplet, au regard de l’enjeu, et de l’ambition de la Commission elle-même. Car en matière d’optimisation et d’évasion fiscales, chers collègues, vous le savez, ce qui importe au moins autant que d’obtenir des informations, c’est de les partager, de se les échanger, entre acteurs concernés. Il s’agit d’ailleurs de la raison d’être de la directive de Coopération administrative qui est modifiée par ce texte.

L’OCDE, le Groupe d’Action financière, tous les organismes internationaux soulignent qu’une grande partie de l’optimisation et de l’évasion fiscales, ainsi que du blanchiment d’argent, prospèrent grâce à l’absence ou l’insuffisance de la coopération entre États. De l’avis unanime des experts et des ONG également, l’un des meilleurs outils à notre disposition pour résoudre ce problème multilatéral est l’échange automatique d’informations.

La directive de Coopération administrative est en train de devenir un outil à la hauteur de l’enjeu, malgré la mauvaise volonté du Conseil qui limite chaque fois la portée des projets du Parlement et de la Commission. On peut se figurer le fonctionnement de cette directive comme ces câbles téléphoniques d’autrefois, ou, pour prendre une image contemporaine, comme un « cloud » sécurisé de la donnée fiscale. Dans ce système de partage entre États, qui ne fonctionnait presque pas il y a quelques années encore, nous avons ajouté en quelques années les rescrits fiscaux – avec DAC 3, le reporting pays par pays des multinationales – avec DAC 4, et tout plaide pour qu’on y ajoute également, avec DAC 5, les informations sur les bénéficiaires effectifs.

La Commission européenne dévoile, dans la communication qui accompagne le texte, que c’est son intention également. J’ai donc naturellement conservé l’accès des autorités fiscales aux données, tel qu’il était proposé, et il était ensuite nécessaire d’introduire l’échange automatique de ces données entre les États membres. Les autorités fiscales allemandes ont besoin des informations sur les citoyens allemands qui sont les bénéficiaires d’un trust passif au Luxembourg, en France ou en Irlande. Or, si nous nous limitons au texte de la Commission, les autorités n’auraient pas eu le devoir de s’échanger ces données, ou alors dans des conditions très précises et de façon très indirecte.

Il faut garder à l’esprit également, chers collègues, que sur ce texte comme toujours en matière fiscale, le Parlement européen est consulté, mais les États auront le dernier mot. Dans ce domaine, ils sont prompts pour prendre à l’unanimité des décisions minimalistes. Notre rôle est donc d’envoyer un message conforme à l’ambition qu’attendent de nous les citoyens et la société civile, dans le contexte de scandale fiscal permanent que nous vivons.

Le Conseil a approuvé son compromis aujourd’hui-même en ECOFIN, en limitant un peu la proposition de la Commission. Je propose donc que le Parlement, de son côté, développe plutôt une vision conforme à l’ambition initiale de transparence fiscale, et cohérente avec l’objet de la directive de Coopération administrative – tout en laissant le temps nécessaire aux administrations pour mettre en œuvre cette nouvelle norme.

La justice fiscale a longtemps été le parent pauvre dans l’action de l’Union européenne. Alors que dans de nombreux domaines, nos États coopèrent de façon intégrée et ouverte, en matière de lutte contre l’optimisation et l’évasion fiscales, ce n’est pas le cas. La diplomatie fiscale ne peut plus être un marchandage de couloirs entre experts. En instaurant l’échange automatique de ces informations, nous participons à la rendre plus méthodique, plus efficace et plus utile aux administrations et citoyens de nos pays.
